Terms of Service ("Terms") - Nuked Solutions FZCO Please read these Terms of Service ("Terms") carefully before using any software products provided by Nuked Solutions FZCO ("Nuked Solutions," "we," "us," or "our"). By purchasing and activating any licenses for our software, you agree to be bound by these Terms. License Activation and Refunds 1.1. Upon purchasing a software license from Nuked Solutions, you will receive an activation key or license file, enabling you to activate and use the software. 1.2. Once a license has been activated, it is considered in use and non-refundable. We are unable to offer refunds for activated licenses. 1.3. It is your responsibility to carefully evaluate the software and ensure that it meets your requirements before activating the license. Software Usage 2.1. The software products provided by Nuked Solutions FZCO are protected by copyright and other intellectual property rights. Your license to use the software is non-transferable and non-exclusive. 2.2. You may use the software only for the purposes specified in the documentation or license agreement accompanying the software. 2.3. You agree not to distribute, rent, lease, sell, or sublicense the software or any portion of it to any third party without our prior written consent. 2.4. You may not modify, reverse engineer, decompile, or disassemble the software or any part of it, except to the extent expressly permitted by applicable law. 2.5. You shall not use the software in any manner that violates any applicable laws or regulations or infringes upon the rights of any third party. Support and Updates 3.1. Nuked Solutions FZCO provides support and updates for its software products as described in the documentation or support materials provided. 3.2. We reserve the right to modify, enhance, or discontinue any software product at any time, without prior notice. However, we will make reasonable efforts to provide advance notice of any significant changes or discontinuations. Limitation of Liability 4.1. Nuked Solutions FZCO and its directors, officers, employees, affiliates, and agents shall not be liable to you or any third party for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of our software products. 4.2. In no event shall our total liability exceed the amount paid by you for the software license giving rise to the claim. 4.3. Nuked Solutions FZCO shall not be liable for any damages or losses resulting from the use of third-party software or services in conjunction with our software products. Indemnification You agree to indemnify, defend, and hold harmless Nuked Solutions FZCO and its directors, officers, employees, affiliates, and agents from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorney fees, arising out of or in connection with your use of our software products or any breach of these Terms. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nuked Solutions FZCO is located. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts in that jurisdiction. General Provisions 7.1. These Terms constitute the entire agreement between you and Nuked Solutions FZCO regarding the use of our software products and supersede any prior agreements or understandings, whether written or oral. 7.2. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. 7.3. Nuked Solutions FZCO's failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Prohibited Users 8.1. Employees of game companies, including but not limited to developers, publishers, or distributors, as well as employees of anti-cheat organizations, are strictly prohibited from using our software products. 8.2. By purchasing and activating a license for our software, you represent and warrant that you are not employed by a game company or an anti-cheat organization. 8.3. Nuked Solutions FZCO reserves the right to verify the employment status of any user and may terminate their license without refund if they are found to be in violation of this provision. By purchasing and activating a license for our software, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree to these Terms, you should not purchase or activate any software license provided by Nuked Solutions FZCO.
